In Moby-Dick, Ishmael declares, "Be it known that, waiving all argument, I take the good old fashioned ground that a whale is a fish, and call upon holy Jonah to back me." Few readers today know just how much argument Ishmael is waiving aside. In fact, Melville's antihero here takes sides in one of the great controversies of the early nineteenth century--one that ultimately had to be resolved in the courts of New York City. In Trying Leviathan, D. Graham Burnett recovers the strange story of Maurice v. Judd, an 1818 trial that pitted the new sciences of taxonomy against the then-popular--and biblically sanctioned--view that the whale was a fish. The immediate dispute was mundane: whether whale oil was fish oil and therefore subject to state inspection. But the trial fueled a sensational public debate in which nothing less than the order of nature--and how we know it--was at stake. Burnett vividly re-creates the trial, during which a parade of experts--pea-coated whalemen, pompous philosophers, Jacobin lawyers--took the witness stand, brandishing books, drawings, and anatomical reports, and telling tall tales from whaling voyages. Falling in the middle of the century between Linnaeus and Darwin, the trial dramatized a revolutionary period that saw radical transformations in the understanding of the natural world. Out went comfortable biblical categories, and in came new sorting methods based on the minutiae of interior anatomy--and louche details about the sexual behaviors of God's creatures.

When leviathan breached in New York in 1818, this strange beast churned both the natural and social orders--and not everyone would survive.

Open Question: Couple Different Unrelated Tax Questions?
1. My husband and I got married in 08 and will be filing jointly. While looking over a tax calculator I seen there is a box for the stimulus payments amounts from earlier in 2008. Is it safe to assume that we will just add our payments together for this box? I haven't looked at the actual tax forms to see if there is a line regarding this. 2. My husband is an owner operated delivery driver and has a 1099 misc. Using the mileage rate for 2008 and miles driven, his mileage credit is coming out to be about $2000 more than he made. This is the first year that this has happened in his 3 years of doing this job. He did drive more miles in 2008 by taking on more out of state deliveries than doing just local ones in years past. Open Question: Government taxed my car which was sold long time ago, what am I supposed to do?
I had a mazda 6. It was registered from March 05 to July 05. I sold it since I left US. I came back US and I got the mail from city hall which they charge me from 05 till now. I didn't pay the 05 tax. So, I should pay the tax for 05 and penalty. But, I think it is quite unreasonble to pay tax from 06 to 08 because I didn't drive that shit at all. The thing is I sold the car to the local dealer and I didn't return my license plate to the DMV because I believed the dealer would deal with it himself. I checked the carfax history and it says the vehicle registration was transfered to other guy september 05. Can anyone please tell me what am I supposed to do to avoid paying tax from 06 to 08? Open Question: Am I The Only Person Who Thinks Photoshop Is Overpriced and Overrated?
Photoshop costs an arm and a leg to buy. I went to a local electronics store the other day looking to buy a copy (not for myself, but for my girlfriend), and it was well over 300 dollars plus tax. Now I've used PS in the past, and while it's great, I don't think any software program is worth over 300 dollars to buy. I could almost buy an XBox 360 for that amount for crying out loud. (more...)

Open Question: I was an expat working in Asia, I lost my job and moved back to US can I file for unemployment?
I am a US citizen - I worked for a bank in the US for a few years and then I transferred to the Asian division. I have been laid off and moved back to the US. Am I eligible for Unemployment? My local state unemployment office in New York says no because while abroad I paid Federal but not State Taxes - I was paid from the asian funds of the of the bank. Is there anything I can do? I own an apartment in New York and paid the property taxes and also taxes on the income from subleting, but was not required to pay state taxes and employer did not pay Unemployment insurance on me once I moved 3 years ago, prior to the transfer they did. Open Question: if i have to pay council tax for the duration of the summer while changing courses am i entitled to benefits?
last year i began a course at westminster university, during the summer i changed courses externally through ucas to the same university (could have done it internally but i was unaware of that at the time and im not sure if that has any relevance). i digress. my question is that although i supplied them my local council (harrow), when i moved in this june with a certificate saying that i was a student on a course last year and then later supplied them with a certificate informing them that i was on a new course at the same university they are still insisting that i owe them council tax for the 3 month summer period. as far as i was aware the tax exemption covered my year including the summer break regardless of my changing course, apparently this is not the case within harrow and so i wanted to know that if i have to pay council tax (im also 24, if that makes any difference) am i also eligible for backdating any benefits from this period also as i was not working for the entire duration and working with a negative bank balance. any ideas on what i steps i could take or is it just the way things go? thanks for any help! Open Question: What should the US federal government be involved with?
I am a libertarian, and I have noticed something about some of the debates here. My basic problem with Feminism and other movements is the means they use to achieve their goals, specifically using the federal government. If anyone wants to support anything, I encourage it, no matter how delusional I may think it is. By support, I mean advocate, fund or organize, on their own. The key for me is, don't make everyone pay for it, require them to agree, and use the government to force people to comply through taxes. The funding of the shelter is not a criminal matter; someone creating a shelter does not impose on another person. T O - Good insight, "I just do not trust people enough, I think too many people would take advantage of the situation and mess it up for the rest." I think this is where the real trouble is. Trust, because you do not trust that people can be responsible and not screw it up, you want others to make the decisions for them, and you are trusting that the government will make a better decision for them? You do realize, you are one of those people that can?t be trusted to make your own decisions. I believe I can make my own decisions, and make my own mistakes, that is what being an adult is about, choices and the responsibilities of those choices. I also think people will make bad decisions, and they wi ooops ......... will make bad decisions, and they will have to deal with them as an adult, who am I (or you, or government) to force them to do otherwise. My bad decisions are my responsibility, not yours or anyone else?s. Requiring others to be responsible for my bad decisions gives me the ability to relinquish my responsibility as an adult and in turn give up my ability to make my own decisions. (more...)

Open Question: How can I restore my marriage?
My wife and I have been married for 22 years. We have 3 children, 6 cars, her dream home (old historic house) and I have a very secure job. I manage all the finances, pay bills, file taxes, manage checking and savings accounts, etc. I'm a Christian actively involved in our local church. But, our marriage needs help. My wife has been sleeping on the couch for the last year. It began because she said that our mattresses hurt her back. Then she said that I "bothered her" in bed when i touched her. She quit kissing me about the same time. When I asked her why she no longer kissed me she said that I had chronic bad breath. We never touch each other. The last time I recall touching her was at our Christmas gathering at my parents house. She was leanging over and I put my hands on her waist like I was going to push her over. She turned around and slapped me several times in front of the entire family (22 people) and told me to never do that again, that she was "very ticklish." After making a spectacle of herself, she proceeded to tell everyone how her Peditrician told her dad that she was the most ticklish child that he had seen. I could go on and on because this has been going on for the last year or so. I understand that there are always 2 sides to every story and I've been searching to try and figure out what I'm doing wrong. She recently told me that I embarrass her in front of friends because I say things that degrade her. I cannot say the subtlest joke about her in public for fear of upsetting her. So, I've learned to just keep my mouth shut and never bring up anything in conversation that may be controversial. I cannot disagree with anything she says so I've learned to agree verbally with EVERYTHING she says. I've been doing this for the last several months or so but we don't seem to be making any headway. Okay, what should I do? I signed us up for the "Fireproof" marriage counseling but we only went to 2 of the 4 sessions. She began the Love Dare with me but it only lasted about 1 week. I don't enjoy being around her anymore because I never know when she's going to blow her top. This is not a healthy way to live a marriage. I hate to say this because it sounds so childish but she behaves like spoiled brat! We are isolated from each other but divorce is not an option. What should we do? Addition - In response to one of the answers, I took her on a romantic weekend trip to Savannah and Beaufort, SC. We rode bikes and walked the beach. My daughter was with us (she LOVES the kids!). I hoped that this trip would help restore our relationship but I don't recall getting a "thank you" from her. Made no difference whatsoever. (more...)
