When a prosecutor tells a judge "this will get resolved b4 trial" is this good in the defendants favor?
My lawyer brought up the term "Brady Material". When he did this the prosecutor acted as if he was on his side. Now this is a case where there originally was a co-defendant whose mother worked for the clerk of courts. His sister also is a county sheriff. When it came time for indictments the grand jury sent him back to lower court and charged me for a felony. The last six months I have spent in worry of losing my family and going to prison for something that was totally not my fault. Last Monday was supposed to be the final day for plea agreement however, when my lawyer presented some information to the prosecutor from preliminary hearing the prosecutor quickly changed his tone. You see in the prelims the "victim" testified the other guy hit him. And then stated we both beat him. The police report states the victim was uncooperative and told them he fell. Well when charges were filed the co-defendant quickly went with his father to people that werent even there to get them to side with him and against me. What he didn't know is that the only other guy to see it is on my side. I was smart enough to have the co defendant type and sign a statement the next day of the incident to cover my butt in case this happened.
Since prelims the "victim" has also changed his story to match the co-defendants witnesses stories. Because everything is documented will he be liable for perjury? Also if they do an investigation and determine the codefendant recruited witnesses what will then happen?
Will I be okay?
Steven F no need to be a dick!!! I am obviously not looking for the perfect answer just opinions. If I were looking for solid legal advice I don't think I would be on here doing so. A person would have to be a moron to think that.

Open Question: Can a person go to prison to serve time if no evidence exist?
To make a long story short, my brother has been acused of carjacking of course he did not do it. The guy is wrongfully acusing him. He already went to the preliminary hearing they found no cause, but they have to go to another prelimanary hearing because of the prosecutor . There was a different judge and determined that there was cause. He is now on house arrest waiting for a trial he does not deserve. On the other side , there is no evedince of nothing, the car has not been found by police only thing the other party has is a report and the guy saying that my brother did it. How can he be a two places at once? I live in Puerto Rico and I am scared my brother is 100% innocent. His trial starts in two weeks and I wanted to ask anyone who knows about court stuff.

The IT director opened the department staff meeting today by saying ?I?ve got some good news and some bad news. The good news is that management approved the payroll system project this morning. The new system will reduce clerical time and errors, improve morale in the payroll department, and avoid possible fines and penalties for noncompliance. The bad news is that the system must be installed by the end of December in order to meet new federal reporting rules, costs must be within the budgeted amount, the new system must interact with existing systems, and the vice president of finance insists on approving the final design.?

Four months ago, Pembroke Imports hired David Jackson away from an advertising agency, and made him the director of marketing. Jackson recently submitted a systems request to redesign Pembroke?s customer billing statements. Hannah Holt, the systems analyst assigned to do the preliminary investigation, interviewed Jackson to determine the reasons for the request. David explained that the current statements are much too unattractive and dull.
?Pembroke needs to update its image,? he said. ?We have to show our customers that Pembroke Imports has contemporary ideas and tastes. The best place to start is with the monthly statements we send them. We need something more eye-catching, more artistic, more upbeat!?
Hannah next interviewed the director of accounting, Karen Alexander, who oversees the acoounts receivable (A/R) system, which produces the monthly customer statements. Karen told Hannah that no problems with the accounts receivable system have been reported and no complaints from the customers about the statements have ever been received. She assured Hannah that the current forms were clear and easy to understand.
Confused, Hannah decided she should talk with Cecile Collier, the manager of customer relations. Cecil assured Hannah that Pembroke was having no problems with its customers. She even showed Hannah the latest annual report, which clearly showed that Pembroke Import?s annual sales were increasing at a healthy pace.

Resolved Question: As a parent how do you feel when you read a story like this Undocumented Local man charged in son?s death ?
BLACKFOOT ? Twenty-one-year-old Blackfoot resident Ricardo Lopez-Santillan has been charged with involuntary manslaughter in the death earlier this month of his four-month old son.
Lopez-Santillan was arraigned on the charge before 7th District Magistrate Judge Charles L. Roos Thursday and his preliminary hearing scheduled for Jan. 7 at 1:30 p.m.
He is being held in the Bingham County Jail under $50,000 bail and an immigration hold for being an undocumented immigrant.
Lopez-Santillan was originally charged with injury to a child and his preliminary hearing on that charge was scheduled for Thursday, but instead of a hearing Bingham County Prosecutor Scott Andrew filed a motion to amend the charge to involuntary manslaughter and he was arraigned before Roos at the same time.
According to court records, Lopez-Santillan allegedly caused severe brain damage to his infant son on Nov. 18 when he shook him at the home where he lived with the baby's mother.
The baby was taken to Bingham Memorial Hospital, transferred to Portneuf Medical Center, then Life Flighted to Primary Children's Hospital in Salt Lake City where staff contacted Bingham County law enforcement to report a diagnosis of shaken baby syndrome.
An arrest warrant was faxed to the University of Utah Police who arrested Lopez-Santillan at the hospital on Nov. 26 on a charge of injury to a child. Does it bother you when illegals like Carlos Guillerro Posada accused of killing Alabama woman are here illegally ? Mobile prosecutors on Friday described Carlos Guillerro Posada as a flight risk, and a judge subsequently refused to set bail for the accused killer.
Presiding Mobile County District Judge Charles McKnight was told that Posada, 34, had been declared an illegal alien in June. He was reportedly deported once before but made his way back to the United States.
In April, the body of 23-year-old Sharon Nicole Lee was found along a south Mobile County road. Lee was from Butler County, near the town of Georgiana, officials said.
In September, police charged Posada with murder in connection with Lee's death.
According to earlier news accounts, a truck driver spotted what he first believed to be a mannequin lying in a ditch alongside an unpaved Interstate 10 service road in the Theodore area.
Lee's body was partially submerged in bloody water, according to the driver. Clad only in blue jeans, she had clearly suffered physical trauma.
In court Friday, officials said Posada is accused of cutting Lee in the face and running over her with a vehicle before dumping her body in the ditch.
Assistant District Attorney Matt Seymore told McKnight he believed Posada was a flight risk because of his illegal immigrant status and urged that the judge continue holding him without bail.
McKnight appointed Mobile attorney Dom Soto to represent Posada.

HAVERHILL -- A Lawrence man who police in Haverhill charged with assaulting his former girlfriend by pouring a one-gallon pitcher of 370-degree frying oil over her head was in this country illegally.
According to court documents, Guatemalan native Oscar Rodas, also known as Jose Garcia Martinez, 23, of Lawrence, has also gone by the names of Samuel Martinez-Baez, Samuel Baez and Oscar Ochoa. He was deported in 2002 and again in 2006 after police in Lawrence arrested him for disorderly conduct and giving a false name.
Rodas had been on the run since Oct. 27 when he dumped the oil on the woman, investigators said. Police said they received a tip Rodas was staying in Yonkers, N.Y., and officers there raided a home and arrested him Wednesday. He was extradited to Haverhill and was arraigned yesterday in Haverhill District Court where he was ordered held without bail and must appear at a dangerousness hearing on Monday.
Prosecutor Christopher Holland said he expects to receive a detainer/notice of action from Immigration ordering deportation or removal of Rodas from the U.S. He said the deportation order will not excuse Rodas from answering the charges against him.
According to police, on Oct. 27, Rodas and his ex-girlfriend, a 32-year-old Lawrence woman, were working a night shift together at the Dunkin' Donuts factory in the Ward Hill Business Park in Haverhill. Police said the attack happened around midnight. According to a police report of the incident, the woman told police she noticed Rodas frying Munchkins while she was ringing up a customer. She said Rodas then took a one-gallon pitcher of hot cooking oil, threw it at her then ran out of the building.

Do you think Kurt Angle, Will return to WWE?
And if so how will it affect WWE and TNA?
Wrestlezone: The Wrestling Observer is reporting that WWE creative has begun brainstorming return scenarios in the event that Kurt Angle decides to return to the company when his TNA contract expires next September. It should be noted that these meetings are simply preliminary, and that no concrete decisions have been made by Kurt Angle in any way. WWE officials were surprised when Angle recently did a shoot interview speaking highly of WWE and even Triple H, which gave them the feeling that he may be more willing to return to the company than people had originally thought.
If Angle does return to WWE, we would most likely see him work a lighter schedule similar to what Shawn Michaels works, where he would appear on TV tapings, PPV's and the occasional house show. It should be noted that although WWE would most likely bring Kurt back into the company if he wanted to return, there are those backstage who feel bringing him back would be a mistake as his departure to TNA two years ago was marred by controversy and his physical condition was a serious concern.

Resolved Question: i want to drop charges?
i filed charges against by bf(who is now my x because of what i have done) no police report was written and no pictures were taken so it hard for them to prove it. i want to drop the charges but i was told by commissioner's office that i cant. i was told by a family friend that is a lawyer that i can go to the court house and its a form to ask for so it will all be thrown out. he grabbed me to calm me down and i was hitting and scratching him but he only grabbed me to calm me down and he put him hand on my neck, not to choke me but to hold me back so i would stop but when i filed the charges i didn't say what i did i just said what he did so i want to drop the charges he not at all abusive or controlling i did it mostly out of anger and i did it days later. so do you think on monday they will let me drop the charges me and him are still friends and we talk but he is away in school so it not necessary to go to court and its more than a month before the preliminary hearing so idk wat to do. do you think they will listen to me? i have no marks and he didnt beat me.
i am in the state of maryland so does anybody know the laws there?...everybody is saying somthing different and i dont know who to believe

THE MYTHBUSTERS HAVE FINALLY given in to the pressure the producers have been under for several years. The show asks the viewers to send their favorite myth in via the internet for the show to consider. Upon receiving their 1 million request dealing with the various September 11th theories, the producers finally cracked.
The 2 hour special slated for an unreleased date in 2009 and will be titled WORLD TRADE CENTER. The program will feature the top 2 most requested WTC theories, controlled demolition and CGI planes - more commonly known as TV fakery. The show will also feature a 20 minute tribute to the Pentagon missile theory conducted by Kari Byron, Grant Imahara,and Tory Belleci. Meanwhile,the stars of the show Adam Savage and Jamie Hyneman will be putting their reputation on the line with the WTC experiments.
The show will feature a 1/3 scale replica of the towers at an estimated $7.2 million price tag. The replica is rumored to have been built outside of the United States to avoid airspace restrictions that they would have encountered at home. The location of the replica towers has remained a secret from the press as gag orders were imposed on the private contractors. The total cost of the production has reportedly amounted to a whopping $25 million, which the Discovery Channel believes it will reclaim by selling Super Bowl priced ads during the 2 hour event. The Discovery Channel expects the special to be the highest viewed non sport related program in history. It has been reported that an anonymous aerospace company donated a miniature Boeing built to Jamie and Adams specifications that will be 1/3 the mass, weight,and size, of a real Boeing and will carry 1/3 the amount of fuel as well.
