Open Question: can someone be sued for misdiagnosing an X-Ray?
I had an X-Ray a month ago, the doctor looked at it, and said my foot was not broken, Than this week, I had another X-Ray, by a specialist, and he said it was broken, and if it didn't get better it would need sergery. Since the first X-RAY, was misdiagnosed, it may be possible more dammage was done to my foot, that possibly could have been prevented. Can the first people who took the X-Ray, be asked to cover the costs of sergery. (more...)

Resolved Question: Will admitting fault keep me from filing suit for damages?
My insurance company has told me that they have assigned blame for a tire blow out accident to me because I "over corrected." No one was issued a ticket by the Florida Highway Patrol, either. So I don't understand how they could take that position. Here's my dilemma, I want to sue the car rental company and/or the tire manufacturer, and the hospital which misdiagnosed my injuries. If I accept their settlement so that my son can get his teeth fixed which were damaged in the accident, will I lose my right to file suit against the other parties that I feel are responsible for the accident and our injuries. I do not currently have plans to sue the insurance company. (more...)

Resolved Question: Can I sue the hospital?
Hi, i want to know if i can sue the hospital I was diagnosed this year with a blood disorder that the hospital misdiagnosed for over 1 year. Not only did they miss it for over a year, but they had the result from over a year ago showing that my blood disorder had started. I went to emergency over 7 times in the 1 year period and they had the results every time i went there as they did blood tests every time but they failed to tell me every time for over 1 year, so i was very sick during this period, it was picked up by my local GP when i was nearly ready to die as my hemoglobin level dropped very very low. All my organds where shutting down and i nearly died. The hospital knew i was sick for 1 year and did not tell us or notify my local gp. And since then ive been admitted to hospital, ive had many treatments that they normally give to cancer patients and im on medication and will be for over a year at the least. Can i sue the hospital? I have syringoma under my eyes . They are raised sweat glands and I had them removed with laser by a dermatologist last week. Total cost $800 Last year I walked into a "spa" and asked a licensed aesthetician what the bumps under my eyes were and if she can remove them. She said they were mere fat deposits and she can dissolve them with an electronic needle. So I paid her $30 to treat one tumor . Now I have a scar under my eye. 1. She misdiagnosed me. And she was not qualified to make such a diagnosis. She should have told me to goto a dermatologist instead. 2. She mistreated using the wrong equipment resulting in a permanent scar . I did complain to her and she said she was in business for 10 years and that I don't know what I'm talking about. The scar is very small...but it is there. Do I have a case ? (more...)

One Saturday afternoon, my husband and I were at a friends place to help them move scrap metal from their farm. I am about 10 weeks pregnant and unable to help with this, so I was waiting with my husband to see how they wanted it loaded. Suddenly, my husband got an intense headache, couldn't see, couldn't walk (especially with his left side), could hardly speak, and fell to his knees. Our friend helped my husband (we'll call my hubby "B") to the car and we immediately drove to the nearest hospital. Upon arrival (B being carried in by our friend) B was asked if he was on any drugs. I understand that this is common practice, but they kept accusing him of doing drugs repeatedly. Soon after, B gets sick (and me with morning sickness began to get sick myself.) The nurse yells at me telling me I need to go sit in the waiting room because she doesn't need two sick people there. I told her I was pregnant and ignored her as I walked into the room. The doctor then came in the room, asked a couple of questions, and then with no tests or anything, the doctor told him it was just a migraine and doped him up with a TON of drugs, such as a muscle relaxant, a migraine medication, an anti-histamine, a pain killer, and several others. We left and I was able to get him home and to bed as quickly as I could. The next day, Sunday, we stayed home and just tried to relax. However, B was still having trouble walking and using his left side. We have no medical education and thought that maybe this could be what was left over from all the drugs he was given. So, we ignored it for the time being. The next day, B was unsure if he could drive, so he had me take him to work. Since this was a fair ways away, I just waited around town for him. About an hour or two after he got to work, I get a call from B telling me that something isn't right and that he needed to go to the hospital. Thankfully, this was a different hospital. The second he got into the ER, he was told it sounded like a neurological problem and ordered a cat scan immediately. Sure enough, B had had a stroke that weekend. We spent three days and two nights in the hospital. Everyone was amazing at the second hospital and treated both me and my husband with every kind of care that should be shown by the hospital. As well, while we were there, we were given literature strokes, and B was showing every single sign of having a stroke when he walked into the first hospital. Now B is still having trouble with his fine motor skills in his left hand and when he is tired, he can hardly walk on his left leg. Do we have any grounds to sue the first hospital or their doctor? Not only do we have the proof they misdiagnosed the stroke, but we also have witnesses of our friends who heard them yell at me and kept accusing my husband of doing drugs. This whole thing has gotten me stressed out beyond compare and I am worried about the effect of this stress on our baby. As well, does anyone know a lawyer in the Denver area we could talk to? I am really desperate and need some advice regarding what to do. (more...)

I am 20 yrs old and this past January I went to my doctor because I had been experiencing sudden bloating in my stomach and random pains. While I was there, I told my doctor I had been experiencing pain during sex and she just told me to use more lubricant and fore-play. She thought the bloating and pain may be heartburn and/or IBS and prescribed some meds. and said I should get an ultrasound but when I went back for a follow-up a week later and my symptoms were subsiding she just assumed that it was a G.I. problem and never mentioned the ultrasound at the follow-up so my parents did not think it was necessary. In the beginning of October the same symptoms returned and I went for my annual exam and during my gyno exam with the same doctor I told her she was really causing me pain and reminded her that I had told her about this pain in January. She felt my stomach and requested an ultrasound saying the she felt a mass. Well now my parents and I obviously felt an ultrasound was necessary.. there was no mention of other possibilities in January besides for the suspected G.I. problems (IBS and heartburn). I had an ultrasound done which found my right ovary to be enlarged to twice the size of a normal ovary and a cyst within the ovary that is also quite large.. after speaking with my doctor and hearing the report I immediately found a new gyno. My new gyno told me I may have to have my ovary removed with the cyst at this point and now I am wondering if I can sue my old doctor for misdiagnosing me. What do you think? What would you do if you were 20 yrs. old and told you may lose your ovary since this had not be caught sooner? My parents and I think I have a malpractice lawsuit.. what do you think? I got a second opinion and my new doctor ordered a follow-up ultrasound ASAP and told me the type of cyst I have will most likely only be removed with my ovary... Im only 20yrs old my doctor ignored my complaint of pain during sex and now I may lose my ovary because she just brushed it off... isnt that malpractice? (more...)

Resolved Question: They talk about increasing medicare, and making sure everyone has health care. But they haven't said how?
Health care prices will not go down, as long as insurance companies have to pay billion dollar law suits for mal-practice, or misdiagnoses. This country is sue happy, and we all pay for it. preventative health care will make health care more effective, but not cheaper. Tylenol will still cost $300 a bottle, because hospitals have to pay insurance against getting sued in case they get the wrong prescription, and another victim with a tummy ache gets to sue the hospital for millions. I'm not looking for an affordable health plan, I'm talking about fixing the lucrative law suit problem. (more...)
