The Colorado Statute of Limitation is 8% on interest if no interest is stated in contract. I have a collection agency/law office suing me for a credit card debt. In the information provided, there was no interest rate stated in the Credit Card Holder Agreement. By default, should the interest only be 8%? Is the collection agency/law office in violation? On a side note: I already disputed the debt with the Original Creditor since the debt was invalid. The Original Creditor duplicated an account and it fell into the hands of a collection agency. The Original Creditor sent a letter stating they deleted the account, but the collection agency is still pursuing it. (more...)

I broke my lease back in April due to unhealthy/unsafe living conditon in the apartment. They have now hired a collection agency to get their money. The apartment we lived in was infested with bed bugs, roaches, graffiti everywhere, rude and illegal neighbors, and everything else you could imagine. I was also harmed by a neighbor intentionally throwing a cigerette on me. I knew I was not going to be able to live there any longer, and I feared for the health of my infant. I explained this to the collection agency, but they don't care. I have the pictures from the apartment and documentation of the living conditions. I understand 2 wrongs don't make a right, but with those conditions, I had to get out of there. I feel like the landlords violated their parts of the lease. I really need help because the collection agency is threating to take 75% of my husband's wages, and we can't afford to do that at the time, and I am not sure they can take that much here in Colorado. I contacted all the HUD and housing assoication too, but they couldn't do anything because it was not their property. Any help is appericated. The link down there has nothing to do with the case. This case is for 3,000. Not $600. I paid the debt on my own because it was the correct thing. I did call HUD and the police. I didn't live in the area. They NEVER showed the apartment we where going to be living in. They showed us a model unit. So, when I moved in I had no idea about the bugs or anything else like that. It looked nice. I have sent them registared mail with return reciept, to tell them to send it back to the orginal creditor, and not to call me. I also requested all the documents they have. My husband and I can't afford to have his wages garnished. I am not employed and we don't have assests either. I re-read the lease. It clearly states that it was their responsibilty to take care of the bug problem and to make sure it was safe and inhabital to live in. I am clearly frustrated with the deal. (more...)

My wife has a old debt in the state of Colorado with a local hardware/appliance store for a significant sum. They have already transferred it over to a debt collector. Three years ago, she made a small payment on it. We got married long after she last made a payment on the debt. She has no assets, and nothing any debt collector can go after. Really, all she has is bad credit and the potential for the credit to improve. While it disgusts me that she is in debt, ultimately the amount of money involved makes me want to get something out of paying the debt before I pay it. The debt being 3 years old, the report on the credit will fall off in 4 years. This is a better solution than paying what amounts to a full month's wages only to get it sitting on her credit for 7 years. There is also the issue of if I start paying on it, being her spouse, I accept the debt as joint property and they can then go after me. So, given those ways I am seeing it, I would want them to completely remove the nastygram off of the debt, making it as if there was never an outstanding balanced or a missed payment for it to be of value to me, rather than a "Overdue, Closed" message on the credit report. What verbiage would I need to use on the Collection Agency to ensure that I get what I would require before I assumed her debt? Or, lacking that, some other benefit I could get from getting this paid off that would be worth 160 hours of work? They knew there were risks involved with getting into their business. I would feel the same for a store that bought 100000 units of an item that won't sell as any collection agency. RM, I researched it, and most definitely the debt cannot be carried on the credit report past 7 years, paid or not. I drove to Colorado from Florida back in December of '07. While there, an older lady ran a stop sign, and t-boned me with both my daughters inside. Everyone was alive, and intact, but shaken up and in a little pain. After staying in Colorado for 2 months longer than expected (due to the repairs needed for the vehicle, medical exams, etc) I came home. After all is said and done, the total bill for medical expenses is approx $2,200. After almost 4 months of having these bills in collections, the insurance company finally came to a settlement of $6,500. My real questions is am i being ripped off? I am young (22) and have never had to deal with anything like this. Is the settlement they are offering reasonable, or are they trying to rip-me off? Thanks in advance. (more...)

i had (one) account with bank of america for a credit credit. it went into collections and i received a letter from an law office to collect the debt. i requested the debt be validated and i was sent a summons instead. i sent another letter requesting account history, statements, etc. I received a couple computer printouts that didn't look like they were from the original creditor. i decide to pull up my credit report and bank of america hit my report with TWO accounts and i only had one account with them. i disputed it with BofA and they are deleting the account that the collection agency / law office is going after. Some things against this law office: didn't validate debt before taking action (court summons) failed to validate debt for requested information charging 30.42% interest when no interest is listed in any agreement (colorado default is 8%) trying to collect on an invalid account the collection agency and law office are the same people but go by different names, should i go after them? ----thanks for all who have answered/gave feedback (more...)
