Open Question: What does the A.I.D. in Colorado consider a "safety item"?
The law states that an auto dealership is not responsible for any repairs to a vehicle that is purchased "as is" or "no warranty" unless it is a "safety item". Does "safety item" mean a part that is specifically designed for safety, like seat belts, airbags, etc.? Or does it cover items that will cause the vehicle to be unsafe if not repaired? I just purchased a used vehicle. Upon test drive, I noticed it was "pulling" to the left. The salesman told me it needed a $40 alignment and it would be fine. Since the price of the vehicle was reduced so much, I would have to pay for it. I agreed and brought them the $40. After two days, I was told that it needed much more work to correct this problem, totaling $250 and to bring them the money or just pick up the car and deal with it myself. Unfortunately, the only thing I have in writing, is the receipt for the $40 that specifically says"for alignment". So, I looked up the state laws and found this part about "safety items".In my opinion, the vehicle is unsafe as it is unless it is repaired. Can I sue them for these costs and be awarded the repair costs or am I just out of luck? If I sue and lose, I will be responsible for court costs, right? I'm disabled and don't have much money so I can't afford this. Any advice from anyone would be sincerely appreciated.

Open Question: Do I have a case for wrongful termination in Oregon?
I recently moved here from California about a year ago, I live with my Wife and Son We rent an apartment in Springfield.
I'm a commercial truck driver for a large Beverage Distribution Company in Eugene. On December 31st 2008 my HR department called me on my route informing me that some of my paperwork wasnt consistent with other paperwork, that basically I listed my children as benificiaries on my 401 K, which i wasnt supposed to do if i was married. Then they looked at my W2 and noticed that i was filing single. The HR dept. asked me if i was married or not I told them I was, they then told me that i needed to go in and see them immediatly after my shift.
Immediatly after getting off the phone with them I called my wife and asked her to get online and make sure that oregon recognizes common law marriage. She told me No. When i got back to work I approached my supervisor and informed him that i think i had just lied to HR because oregon doesnt recognize common law marriage. We then all 3 went into an office where they told me that this is insurance fraud, that I owe them money that was paid covering my wife on the insurance and that I also owe the insuarance company money they paid for her emergency room visit in July 2008. The following day i researched it on the internet myself and came up with some interesting information.
On Friday Jan 2 2009 I gave my supervisor what i had found about oregon and common law marriage. Here is what i gave him ( the link is from the offical colorado state website on common law marriage where i contend she and i lived for a period of time)
Does Oregon have common law marriages?
A common law ?marriage? is not valid in Oregon. However, if a couple is from a state that acknowledges common law marriages (currently 15 states do), and the couple meets the requirements of common law marriage of that state, then the state of Oregon will acknowledge the marriage of that state as valid in Oregon.

Even if a state no longer permits common law marriages, the Full Faith and Credit Clause of the United States Constitution requires all states to recognize and validate common law marriages created in states that do permit them. This means that you and your partner can create a common law marriage in Montana and still have it recognized in New York.

Later on the morning of January 2 2009 I recieved a phone call from my supervisor telling me "Enough of the Fucking Bullshit with this Bullshit Fucking Paperwork you gave to me I dont know if i'm going to Fire you or not but i do know you're in a shit load of trouble so just do your fucking job and i'll let you know when i make a decision."
On 1-7-09 I was fired for submiting false information.

Open Question: How does my essay sound to you?
okay i wrote this essay about smoke-free laws...this is for an AP English course....how does it sound?
Any educated citizen can agree that smoking only leads to consequences, and has absolutely no benefits toward the human anatomy; the issue was emphasized by an article written by Mike Stobbe on December 31, 2008. The research condemned in a Colorado city showed that the ban of smoking in a workplace led to a drop in the percent of heart attacks. The research took three years, but proved to work. Not only did the banning cut smoking rates but reduced damages on other people caused by second-hand smoking. However, some observers mention there is no actual proof that the ban of smoking caused the drop. One thing was for sure whatever it was showed improvement for the citizens of the city. The ban of smoking in public areas in Pueblo, Colorado might just influence other cities to do the same. Obviously, this change improved health not just for the smokers but for the innocent victims and their children surrounded by those smokers.
The restriction of smoking in public areas for three years shows the commitment and the serious attitude toward tobacco. It is to be the longest study ever done on smoking. The images of what tobacco does to humans are instantly pictured in the mind; society has seen images of post-smoking situations and the consequences thrust upon those who smoke. Action speaks louder than words; taking this type of drastic action proved to help society. This is the ninth study done and it is proven that smoke-free laws help reduce heart attacks at no cost. Even with the doubtful observers, the facts are clear; the prevention of smoke will provide a healthy environment whether it reduces chances of heart attacks or not. If serious issues like smoke-free laws cure one of America?s biggest problems-heart attacks-then why only take action in Pueblo, Colorado? America?s health problem is soaring high with obesity, heart-attacks, and other diseases. Reducing one of those issues in a community helps doctors or anybody else medically qualified to focus on solving other concerns in the hospital or scientific laboratory. For example, the heart attack rates in Pueblo dropped from 257 per 100,000 people to 152 per 100,000, and that?s just for the three years. Imagine the progress America will make when a greater commitment is made toward providing smoke-free zones for the public. To reach distant places it has to take the first step.
The affects of second hand smoke affects everyone surrounded in that atmosphere, especially the children. Cigarettes are known for causing cancer and contain more than 50 chemicals. Most of these children have no other choice then to breathe that air; because that?s the atmosphere they are surrounded with. Many of these children live in households with parents that smoke, and are not educated with the dangers of tobacco. The benefit of the smoke-free law guarantees children a safe atmosphere outside their home, where it?s possible to breathe fresh, non-toxic air. Many children receive respiratory tract infections resulting in 7,500 to 15,000 hospitalizations each year. Unlike America, many countries do not warn parents about the dangers of smoking. Like it or not, children grow up to have respiratory complications, like asthma. If smoke-free laws can spread through communities, it can very well spread through countries, therefore improving the universal health system.
The message was loud, clear, and simple in the article. Although it?s not proven that all heart attacks are the result of tobacco, but smoke-free laws definitely reduced the numbers and gives families hope of a healthier air climate. Readers of the article can get motivated to produce similar laws in their communities. The message showed to be efficient and a sign of progress and a promising future.

Open Question: In Colorado in a common law marriage upon the death of one how is the estate divided? 1/2 to spouse 1/2 to kid?
Or is the property given soley to the adult children of the deceased spouse? There are no minor children nor did they have children together. The children are from a previous marriage. Also, if the deceased still owes past due child support can it now be included in the estate settlement?
I am the mother of the adult children, my ex husband is the one who is dying. He has lived with the woman for over 20 years. I just want to make sure my sons get what is rightfully theirs and if possible get the $60,000. 00 plus, child support he owes me, since he never paid it at all in the last 30 years. so where do I start? how do I get it done?

Open Question: Is it legal to for a minor to purchase non-alcoholic beer in Colorado?
I was denied at the local Safeway to purchase a six pack of Coors 0.5%. I've bought it around the state before and was confused when he told me that I had to be 21. I know that a glass of orange juice contains about the same amount of alcohol per ounce. The guy working there seemed like a real yo-yo, and I wanted to be sure of myself to prevent any trouble in the future. He was aware of the products alcoholic content (or lack thereof) and was your basic nerd who had nothing better going for him than to bug others. I know that the national law is that anything more than 0.5% ABV is legal for a Minor, but more strict restrictions vary by state.

Voting Question: Do people in Colorado even have a clue about the government taking away our rights?
I work in a hospital that has to enforce a new law voted and approved by Colorado. People can not smoke on hospital property. Not even in your car on the property. The fine can be up to $300. However, If you cross the street, (off of hospital property) its ok. I think this is absolutely a violation of our rights. I dont smoke and dont like second hand smoke. But the PEOPLE ARE OUTSIDE!!!! I dont see the diffrence in smoking on one side of the street or the other. I think if this is something the government and law enforcement has the free time of enforcing or even making the law then they have missed the point big time. I wished the law could spend their time enforcing important issues like getting the illegal immigrants out of our country, or getting welfare reciipiants off of welfare and able to contribute to society by having a job, like everyone else. Then they can pay back what the welfare gave them. So other people who are having a hard time can benefit as well. The government could spend their time finding ways to everyone having health benefits (at least those paying taxes and that are legal) Sometimes people who do not contribute to society have better benefits then the people working and paying taxes. How on earth could the government think this is fair? I guess because they are spending their time focusing on laws that fine people working. Maybe they are worried birds are going to get cancer from second hand smoke. Good Grief Colorado!!!!
I dont smoke, I would like to see evidence of 2nd hand smoke outside causing cancer. We are polluted with car and aiplane exhaust outside as well as airplanes dumping chemtrails into our "fresh air". what does a cigarrette cause harm outside?

Open Question: Im moving from Pa to Colorado, any culture shocks, laws, auto laws, etc; that i should be aware of?
In two years i am moving to the Leadville area in Colorado from Latrobe Pennsylvania. I'm moving for college purposes but plan on staying there for a long time. Is there any suggestions people have:? Maybe some culture shock i should be aware of? Laws that are different? Pet info? Auto ownership/driving/auto insurance laws? Ways to meet people? things to do? Anything is welcome concerning my move.

Resolved Question: Just curious - Colorado state traffic laws?
How many years does a speeding offence remain on your record if you were pulled over by a state trooper? My friend reckons it's only 3 years but I tell him that it's probably more. He's already paid the fine but he's from out of state and wants to visit Colorado again to see some friends.
